Thailand’s National Anti-Corruption Commission has postponed its report into TrueMove’s 3G deal with state-owned CAT Telecom which was originally due on April 23.
NACC commissioner Methee Krongkaew, who heads the investigation, told reporters that the evidence gathered shows many irregularities. These most notably include possible breaches of article 46 of the frequency allocation act, the public-private joint investment act, lack of any auction and a possible breach of anti-monopoly laws.
Article 46 of the frequency allocation act requires spectrum licence holders to operate the network themselves and not sub-contract it to prevent licence holders from becoming rent collectors.
The PPP act requires that all projects of over one billion baht gain cabinet approval first.
Methee said that the other high profile report commissioned by the ICT Ministry’s that found five breaches was to be taken into consideration by the NACC but he noted it was not legally binding or in any way limiting the scope of his investigation.
He expects his sub-committee to be able to present its findings to the main NACC board sometime in May.
