The board of state-owned CAT Telecom has given the green light to sue concessionaire Dtac for refusing to hand over cell sites as part of its build-operate-transfer concession.

CAT CEO Kittisak Sriprasert said that following the board meeting on 17 August, the board has told him to proceed with taking Dtac to court. He expects that documentation will be ready to forward to the attorney general within the next one or two months.

Kittsak said that Dtac has not transferred ownership of 700 of its 11,000 base stations and this would cause CAT to lose out as it could not monetise the assets.

However, the CAT CEO said that Dtac had been cooperative all along and only stopped transferring the base stations after problems with the other concessionaire emerged.

The timing is significant as two months would put it exactly on the day of the upcoming 3G auction.
